Withdrawal Instructions – Shipping Rental (Consumers)

Note on precedence: For the German market, the German version of these withdrawal instructions is the legally binding and authoritative version. This English translation is provided for information purposes. In the event of any discrepancy, the German version prevails.

These instructions apply to the rental of Tenniix devices by post by consumers (distance selling). The rental is a paid service (provision of use for a period of time); the exception of § 312g (2) no. 9 BGB (including vehicle rental) does not apply here. The right of withdrawal therefore continues to exist even after delivery of the device.

You have the right to withdraw from this rental contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which the contract was concluded.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, although it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction; in any event, you will not incur any fees as a result of such reimbursement.

without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the device before the period of fourteen days has expired. We bear the cost of the return (a return QR code is provided).

Compensation for value in the event of an early start of the rental service

If you have requested that the rental service (use of the device) should begin during the withdrawal period, you shall pay us a reasonable amount which corresponds to the proportion of the services already provided up to the point in time at which you inform us of the exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract (§ 357 (8) BGB).

End of withdrawal instructions

Express consent to the early start of performance (checkout requirement)

So that use is possible immediately after delivery, we obtain your express consent in the booking process via a separate (not pre-selected) checkbox. Recommended wording:

☐ "I expressly request that the rental service begins before the expiry of the withdrawal period. I am aware that, upon complete performance of the contract, I lose my right of withdrawal, and that, in the event of a withdrawal after the start of use, I have to pay proportionate compensation for value for the rental days already used."

Note: Complete performance of the rental service regularly occurs only upon expiry of the agreed rental period. Until then, the right of withdrawal continues to exist – against compensation for value for the days used.

Sample calculation of compensation for value (illustration)

The following examples are for illustration only. The decisive factor is the clause given a final legal review by a lawyer.

Assumption: Tenniix Pro, 7-day rental for €149 (incl. VAT). Daily portion = €149 ÷ 7 ≈ €21.29/day.

Example Basic (€99 / 7 days, daily portion ≈ €14.14/day):

The days used are measured from the delivery scan (start of rental) until the notification of withdrawal. Any additionally booked options (e.g. loan ball set) are treated separately according to use.

Deposit refund in the event of withdrawal

The deposit reserved for the rental (€350 Basic / €500 Pro, in each case as a pre-auth, no debit) is released promptly after receipt and defect-free inspection of the returned device (target: within 48 hours after the OK inspection, at the latest within 7 days). Any compensation for value for days used and damage beyond normal wear and tear are taken into account – transparently and upon presentation of proof; otherwise full release takes place.
